- Expect Akamai and Limelight's Court Ruling by the End of the MonthToday
-
Dan Rayburn submits:
Lately, I've been getting a bunch of questions asking for the latest news on the Akamai (AKAM) and Limelight Networks (LLNW) patent suit. While there is not much news to talk about, Akamai and Limelight were back in court last month and there is a good chance the judge will issue a ruling by the end of this year.
Even if a ruling comes down in the next few weeks, it is unlikely that the judge will reverse the original decision in Akamai's favor and such a ruling would then just result in Limelight filing an appeal. Since the appeal process tends to move a lot faster, we can expect for both sides to be back in court probably by the second quarter of next year. When that happens, details of Limelight's workaround for the Akamai 703 patent will then be detailed and we'll get a lot more information on what exactly Limelight has done to circumvent the patent in their eyes.

Eric Savitz (Barron's) submits: The National Bureau of Economic Research, the official U.S. arbiter for declaring recessions, today announced that - surprise! - we’re in a recession, and have been since December 2007. I’m not sure who is actually surprised to hear that news; but nonetheless investors used that development and other fresh signs of economic trouble as a pretty good excuse to take some profits after a 5-session rally in which the Dow Jones Industrial Average and the Nasdaq Composite both rallied nearly 17%.
Ergo, the Nasdaq Composite today swooned 137.50, or 8.95%, to 1,398.07. Ouch. That was worse than the 7.7% drop by the Dow, and about in line with the 8.93% slide by the S&P 500. While Black Friday shopping went a little better than expected, there were indications that shoppers stuck to extreme bargains, and left the mall when the deals were gone. Meanwhile, there

Boaz Berkowitz submits:
I used to spend a lot of time on eBay (EBAY), but haven’t in quite a while. So I found myself rather surprised when I purchased nearly all of my holidays gifts on eBay last night. What caused this unexpected departure? An unlikely deal between eBay and Microsoft (MSFT) in which Microsoft will actually pay me to shop on eBay.
How much will they pay me? At first they advertised 10% of my purchase price in a cash back rebate, then I noticed it went up to 25%, and last night it was a whopping 30%! That’s pretty impressive and enough to get even a busy guy like me on eBay’s site for several hours checking out possible gift ideas.
